THE OPEN has been registered in the UK by The R&A for sporting and entertainment services relating to golf's oldest major championship, first played at Prestwick Golf Club in 1860. The R&A trademarked the definite article 'The' as part of the mark to distinguish the championship as the original Open, predating both the US Open and every other 'open' tournament in professional golf.

The first Open Championship was held at Prestwick Golf Club in 1860, contested by eight professionals. The R&A Golf Club of St Andrews took over administration of the championship in 1919. The Royal & Ancient Golf Club of St Andrews separated its commercial operations into The R&A Group in 2004, which now owns the trademark portfolio. The championship's claret jug trophy — the Golf Champion Trophy — first awarded in 1873, is itself a registered design and forms part of the brand's protected intellectual property.
