The following memoradum is entered in the register. - This registration is subject to the terms of an agreement dated 15th February,1965, made between L & A Leather Products Limited (called L.&A.) of the one part and Amity Leather Products Co. (called Amity) of the other part, whereby Amity will not without the prior approval of L. & A. in writing, inter Alia, ()1) cancel or abandon the Mark, ()2) alter the specification of goods, ()3) consent to third parties using or registering the Mark or closely resembling Trade Marks, (4) breach the conditions as to assignment of the Mark in clause 18 of the agreement or ()5) save in the circumstances mentioned in clauses 14, 15 or 16 of the agreement, cancel the entry of L. & A. as a registered user of the Mark. Pursuant to a decision made on the 2nd December, 1969, by a Hearing Officer acting for the Registrar, and in the matter of an application under section 32 of the Trade Marks Act, 1938 by Amity Leather Products Co., the register was, on the 2nd February, 1970, rectified by the total removal of the memorandum at present entered on the register in respect of Trade Mark No.857839.
